Welcome to BrainyGaming. Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the BrainyGaming website and mobile application (the "Service") operated by BrainyGaming Inc. ("us", "we", or "our").

2. Therapeutic Nature of Service

BrainyGaming provides digital therapeutic games designed to support cognitive development. However:

• Not Medical Advice: The content and services provided by BrainyGaming are not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or qualified health provider with any questions you may have regarding a medical condition.
• Supplemental Tool: Our platform is intended to be used as a supplemental tool for cognitive training and should not be used as the sole method of treatment for any condition.

3. User Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

3.1 Child Accounts

Accounts for children under 13 must be created and managed by a parent or legal guardian. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

4. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of BrainyGaming and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

5. Subscription and Payments

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.

• Free Trial: We may, at our sole discretion, offer a Subscription with a free trial for a limited period of time.
• Cancellation: You may cancel your Subscription renewal either through your online account management page or by contacting our customer support team.

6. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

7. Limitation of Liability

In no event shall BrainyGaming, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service.

8. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
